02Accepting these terms

By downloading, installing, accessing or using the VitalUp mobile application or related web services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the application.

03Using the app

• You must be at least 13 years old to create an account. In places (such as certain EEA countries and the UK) where the age of digital consent is higher than 13 (up to 16), users under that age need the consent of a parent or guardian.
• You are responsible for keeping your login details confidential and for activity on your account.
• Give accurate information when you sign up, and keep it up to date.
• You agree not to reverse engineer, disrupt, overload or exploit VitalUp's services or APIs, or use them to break the law.

04Health and fitness data

Data synchronised through Google Health Connect or gathered with built-in sensors (GPS, pedometer, Bluetooth heart rate monitors) depends on hardware accuracy and on what you enter. VitalUp disclaims all warranties about the exact precision of these figures.

How we handle this data is described in the Privacy Policy.

05AI features

• Vita, AI diet plans and the Food Scanner use AI models that can be wrong. Check important figures, such as allergens and calories, before relying on them.
• AI features are only for questions about your health data, general health, nutrition and fitness, and how to use VitalUp. Requests outside that scope may be declined.
• Free and Pro accounts have daily AI allowances, shown in the app. We may adjust them to keep the service fair and running.

06The Arena and community

Your username, display name, photo and Arena progress can be seen by other members, as explained in the Privacy Policy. When you use the Arena:

• Choose a username and photo that aren't offensive, misleading or someone else's.
• Be respectful in challenges, friend requests and cheers. Don't harass or impersonate anyone.
• Don't try to game points, streaks or leaderboards with false or automated logs.

We may remove content, reset scores or limit access to the Arena for accounts that break these rules.

07VitalUp Pro subscription

• VitalUp is free to use. VitalUp Pro is an optional subscription that raises the daily allowance for AI features (photo food scans, Vita chats, insights and AI diet plans). Pro allowances are fair-use limits, shown in the app.
• Pro is sold through Google Play. The price, billing period and any free trial are shown before you confirm, and payment is charged to your Google Play account.
• Subscriptions renew automatically at the end of each period unless you cancel before the renewal date. You can cancel at any time in Google Play (Payments & subscriptions); Pro then stays active until the end of the period you paid for.
• If you cancel during a free trial, you are not charged. Refunds follow Google Play's refund policy.

08Intellectual property

All original software code, interface designs, logos, visual assets and content in VitalUp are the intellectual property of the VitalUp team. The data you log stays yours: you can export it or delete it at any time.

09Ending your account

You can stop using VitalUp and delete your account at any time from Profile > Account details > Delete account, or through our account deletion page. We may suspend or close accounts that seriously or repeatedly break these terms.

10Limitation of liability

To the maximum extent permitted by applicable law, VitalUp and its developers shall not be liable for any injuries, health complications, or indirect damages resulting from workout activities, dietary adjustments, or reliance on information presented in the app. Nothing in these terms limits rights you have under consumer protection laws that cannot be excluded.

11Changes to these terms

We may update these terms as VitalUp changes or the law requires. We will update the date at the top of this page and, for significant changes, tell you in the app or by email. Continuing to use VitalUp after a change means you accept the updated terms.
